Mediation & Settlement
A negotiated resolution can give parties more control over the outcome of a dispute. Mediation provides a structured setting in which an independent mediator helps the parties explore whether they can reach an agreement. Settlement discussions can also take place directly between the parties or through their solicitors.
More about Mediation & Settlement
- We support clients before and during mediation by : helping them identify the issues, assess the strengths and risks of their position, prepare relevant documents and consider workable settlement terms. During negotiations, we advise on proposals as they develop and help clients evaluate how each term would operate after the dispute ends. A useful settlement should address more than the headline amount: timing of payment, releases, confidentiality, costs and the consequences of default may also matter.
Core Elements of Mediation & Settlement
- When terms are agreed: we draft or review the settlement agreement so that the parties’ obligations are clear. We can also assist in recording a resolution through a consent order where appropriate. Our role is to help clients negotiate with a clear understanding of their legal position and reach terms that can be implemented in practice.
