Conveyancing
A property transaction involves more than simply signing a Sale and Purchase Agreement. Parties need to understand what is being bought or sold, the terms of payment and completion, the status of the title, and any conditions, restrictions or outstanding matters that may affect the transaction.
More about Conveyancing
- We advise and assist clients in relation to the sale, purchase, transfer and financing of properties in Malaysia: Depending on the transaction, our work may include reviewing and preparing Sale and Purchase Agreements and related documents, conducting title and relevant searches, advising on title conditions, restrictions in interest and consent requirements, coordinating with banks and other solicitors, and preparing the documents required for completion, transfer, discharge and registration.
- We also assist with matters arising from: existing bank charges, outstanding loans, redemption and discharge of charges, perfection of transfer and charge, and transactions where completion is subject to another transaction being completed. Where applicable, we also advise on the relevant procedural and documentation requirements relating to property taxes, consents and registration.
Core Elements of Conveyancing
- For sub-sale and other property transactions: we help clients understand their contractual obligations, including important dates, payments, conditions of completion and documents that need to be provided. We work closely with the relevant parties to identify potential issues at an early stage and coordinate the necessary steps towards completion.
- Property transactions can involve multiple parties: including purchasers, vendors, developers, banks, financiers, management bodies, government authorities and other solicitors. We aim to make the process clear and manageable by explaining the relevant steps, keeping clients informed of important developments and addressing issues as they arise.
- Our approach is practical and client-focused: We aim to facilitate an orderly and efficient transaction while protecting our clients’ legal and commercial interests and ensuring that the agreed terms are properly documented and carried through to completion and registration.
Questions You May Wonder?
Ideally, seek advice before signing an offer, paying a deposit or entering into a sale and purchase agreement. Early review helps you understand the proposed terms and identify title, financing or completion issues before making a commitment.
Depending on the transaction, useful documents include identification or company documents, the property title, previous sale and purchase agreement, loan details, assessment and quit rent receipts, and any existing offer or booking form. We will explain what else is required.
The timeframe depends on the agreement, financing, title status, required consents and any existing loan redemption. We review the transaction and explain the contractual deadlines and factors that may affect completion.
