Post-Adjudication Court Applications
A CIPAA adjudication decision may require further steps after it is delivered. A successful party may seek to enforce the decision, while another party may consider whether there are grounds to apply to set it aside or stay its enforcement. These are distinct applications, each with its own legal requirements.
Post-Adjudication Court Applications
- We advise clients : on the effect of an adjudication decision and represent them in related High Court applications under CIPAA 2012. Our work includes applications to enforce a decision under section 28, set it aside under section 15 or stay its enforcement under section 16. We review the adjudication record, identify the relevant grounds and prepare the evidence and submissions needed for the application or response.
Post-Adjudication Court Applications
- The court application must be considered : in the context of the wider dispute. The parties may also be pursuing arbitration, litigation or settlement concerning their underlying contractual rights. We help clients understand how those processes interact and what each proposed step is intended to achieve. Whether acting for the party seeking payment or the party resisting an application, we provide focused advice on the available grounds, procedural steps and practical consequences.
